These Terms of Service (“Terms”) govern your access to and use of the Whale Flow website, APIs, alerts, AI-assisted analysis, reporting, and related services (collectively, the “Service”) operated by the Whale Flow project (“we,” “us,” or “our”). By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You may not use the Service where prohibited by law. You are responsible for ensuring that your use complies with applicable laws, including rules on digital assets, data protection, and export controls.
2. Description of the Service
Whale Flow provides tools to monitor public blockchain activity, classify large transfers, deliver alerts, display analytics, and generate AI-assisted market commentary. The Service is provided for informational and operational support only.
3. Not Financial, Legal, or Investment Advice
Important disclaimer
Nothing in the Service constitutes financial, investment, trading, tax, or legal advice. We do not recommend buying, selling, or holding any asset. AI-generated text, reports, scores, and signals may be incomplete, delayed, or incorrect. You alone are responsible for your trading and investment decisions and for any losses you incur.
4. Accounts and Security
You agree to:
- Provide accurate registration information and keep it up to date.
- Maintain the confidentiality of your credentials and notify us of unauthorized access.
- Not share accounts, scrape the Service in violation of these Terms, or attempt to bypass access controls.
- Not use the Service to harass others, distribute malware, or violate third-party rights.
We may suspend or terminate accounts that violate these Terms or pose security or abuse risk, with or without prior notice where reasonably necessary.
5. On-Chain Data and AI Outputs
Blockchain data is public but may be mislabeled, incomplete, or processed with delay. Heuristics (exchange tags, flow classification, thresholds) can produce false positives or negatives. Large language model outputs are probabilistic and may hallucinate facts or misread context.
You should independently verify critical information before acting on it. Do not rely on alerts or AI reports as the sole basis for risk management or execution.
6. Trading Signals and Third-Party Bots
If you enable trading-related features, you acknowledge that:
- Automated execution carries substantial risk, including total loss of capital.
- Signals may not execute as intended due to latency, partial fills, exchange rules, or software bugs.
- Third-party software (e.g., exchanges) is not under our control; their terms apply separately.
- You configure leverage, position size, and API keys at your own risk.
7. Acceptable Use
You must not:
- Reverse engineer, overload, or disrupt the Service or underlying infrastructure.
- Use the Service to facilitate fraud, money laundering, sanctions evasion, or illegal activity.
- Resell or commercially exploit the Service without our written permission.
- Submit content that infringes intellectual property or privacy rights.
8. Intellectual Property
We retain rights in the Service, software, branding, and documentation. You receive a limited, non-exclusive, revocable license to use the Service for your internal purposes in accordance with these Terms. On-chain data remains subject to its respective sources and licenses; your use of such data must comply with applicable terms.
9. Privacy
We process account and usage data to operate and improve the Service. Authentication may use third-party providers (e.g., Google, GitHub). We do not sell your personal information. Additional privacy practices may be described in a separate Privacy Policy when published.
10. Disclaimers
As-is
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU PAID NOTHING.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
13. Changes
We may modify the Service or these Terms at any time. Material changes will be indicated by updating the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree to revised Terms, stop using the Service.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access for any reason, including maintenance, legal compliance, or breach. Sections that by nature should survive (disclaimers, limitation of liability, indemnification, governing law) will survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where the operator of the Service is established, without regard to conflict-of-law rules. Disputes should first be raised through good-faith contact; if unresolved, they may be submitted to the competent courts of that jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
16. Contact
For questions about these Terms, contact the Whale Flow administrators through the support channel associated with your deployment or the contact information listed on the official project site.
